MARIA MONTSERRAT ESCODA FORTUÑO, owner of the website www.montserratescoda.com, presents the contractual document that will govern the purchase of products and services through the eCommerce platform.
On the other hand, the User – Client (hereinafter the User) is the party who contracts the course/service from the provider. The User may be either a natural person, adult over 18 years of age, or a legal entity.
And additionally, the Student is the natural person designated by the Client as the beneficiary of the provider’s online courses. The student may be the Client themselves if they are of legal age.
The user and/or student will be registered on the website through a username and password, for which they are fully responsible for use and safekeeping, and are also responsible for the accuracy of the personal data provided to the provider.
BOTH PARTIES ACCEPT this document, which implies that the user:
a. Has read, understands, and comprehends what is stated herein.
b. Is of legal age and has sufficient capacity to contract.
c. Assumes all the obligations stated herein.
d. Has read and accepts these general terms and conditions of purchase from the moment any product or service offered is acquired.
This document may be printed and stored by the Users.
The provider makes the email address info@montserratescoda.com available for any queries regarding these conditions.
These conditions shall remain valid indefinitely and apply to all purchases made through the provider's website www.montserratescoda.com
The provider reserves the right to unilaterally modify these General Conditions, without affecting goods or promotions acquired before such modifications, in order to improve the products offered. In any case, these general conditions must be consulted before purchasing the products.
It is advisable to save a copy of the data contained in the purchased products/services.
The provider is not responsible for the consequences that may result from improper use of the products or services available for contract/purchase on the website.
The provider's civil liability for the products and services supplied is limited to their value; the user waives any claim against the provider for any concept in any case of dissatisfaction with the services purchased on the website www.montserratescoda.com, as well as possible failures, slow access, or errors in accessing the website, including loss of data or other information that may exist on the user's computer or network when accessing www.montserratescoda.com.
2.1 Scope of application:
The purpose of this contract is to regulate the contractual relationship for the purchase of services (courses, consultancy, mentoring, and conferences) and products (ebooks) between the provider and the user at the moment the latter accepts these purchase conditions during the contracting process by checking the corresponding box. These GC will apply from the day the purchase is made.
The contractual purchase relationship entails the delivery and/or access to a specific service/product in exchange for a set price, publicly displayed on the website. The specific details of each offered service—content, price, payment method, type of service, etc.—are contained in this document, specifying the contracting and sales procedures for each service and product.
Online courses will be conducted online and the student can follow them from anywhere. The teaching method is based on a combination of videos and texts created exclusively by us. MARIA MONTSERRAT ESCODA FORTUÑO reserves all rights.
We reserve the right of admission, after evaluating who the service or training is intended for. Educational materials are created exclusively by us.
The specific characteristics of each service or training, as well as pedagogical materials, will be described in the corresponding service description.
2.2 Territory of application:
The provision of online services from www.montserratescoda.com is available worldwide.
2.3 Capacity to contract:
To contract the services, you must be of legal age and have the legal capacity to contract.
2.4 Customer acceptance:
Validation of an order through the website www.montserratescoda.com is done via email and implies automatic acceptance of these GC. These conditions are available on the website www.montserratescoda.com or, upon request, we can provide them by email.
2.5 Modification of the General Terms and Conditions:
The provider reserves the right to make changes and/or modifications to these GC. We advise our clients to review them regularly. If changes or modifications are made after an order is placed, the conditions in effect at the time the order was made shall apply.
3.1 Price publication:
The prices of the services and products are those shown individually on our website www.montserratescoda.com.
The provider is committed to displaying prices as transparently as possible. The applicable prices are those shown on the website at the time of the order or purchase. Prices are expressed in euros and sometimes include taxes. They may be modified at any time without prior notice.
Prices for personalized sessions (conferences) are agreed between both parties once the contracting process has been initiated by completing the corresponding form on the website.
All orders are placed and paid in euros. The User is solely responsible for paying the invoices issued to them. All services and products must be paid in full at the start, or in the case of ebooks, at the time of purchase.
For invoicing of conferences, we kindly request that you send your billing details to our contact email so we can issue the invoice. For all other services, invoicing is automatic.
3.2 Information on services:
The information in our advertisements, brochures, other written material, our website, or provided to you constitutes an invitation to make a purchase. The content of www.montserratescoda.com is constantly updated to offer our clients the most complete and detailed information possible.
All contractual information presented on www.montserratescoda.com is shown in Spanish, and communication with clients and users, as well as the formalization of the contract, will be conducted in this language. However, if the client wishes, it may also be conducted in Catalan or another language, as long as this is indicated before starting the contracting process.
In the case of courses, the language of delivery will be the one specified in the course itself.
For consultancies, conferences, and mentoring, the service may be provided upon request in Spanish, Catalan, or English.
3.3 Response time for service purchases:
The purchase receipt is sent to the client as soon as their order is processed. In the case of courses, mentoring, conferences, or consultancy, the client receives a confirmation email once the order is processed along with the payment receipt. This is a legally binding proof of order when combined with the original invoice.
3.4 Order process and validation:
Registering for training via the website constitutes irrevocable acceptance of these conditions and may only be contested in limited cases outlined herein.
Consequently, the provider cannot be held responsible for failure or incorrect delivery of the contracted services due to the User entering incorrect data.
In the event of disputes concerning the nature of the provider’s services or the Client/Student’s use of the website, transaction data from bank transfer, Stripe, or PayPal may be used as evidence.
In the case of consultancy, conferences, or mentoring, the wait time for booking an appointment may range from 1 month to 9 months. At the time of purchase, the desired date can be selected. If no dates are available, there is an option to join the waiting list, and MARIA MONTSERRAT ESCODA FORTUÑO will notify you of availability.
When purchasing a course, a password will be sent to access it. You will have 12 months of access to the course.
3.6 Fraud:
If MARIA MONTSERRAT ESCODA FORTUÑO suspects or detects any anomaly or fraud, she reserves the right to cancel the transaction for security reasons.
To access the services offered by the provider, the user will only be asked for the necessary data to process the order.
Once the desired service has been selected, the following contracting procedure applies according to art. 27 of Law 34/2002 on Information Society Services and
Electronic Commerce:
- For consultancy and mentoring:
1. Choose the desired service by clicking “book”.
2. A new tab will open requesting personal data to complete the booking. Consent will be requested to save data. If granted, it may be used to send service updates. If not, the data will be saved for future purchases only.
Check spam folders and ensure your contact information is correct.
3. You must check the boxes accepting the General Terms and Privacy Policy.
4. A Calendly tab will open where you select a time and proceed to payment.
5. Click “schedule event” to finish and receive confirmation with date, time, and payment details.
- For courses and ebooks:
1. Choose the desired course or ebook by clicking “buy now”.
2. A new tab will request personal data. Consent is also requested to store your data.
3. You must check the boxes accepting the General Terms and Privacy Policy.
4. A Stripe tab will open for payment. Click “pay” to finish.
5. You’ll receive a confirmation email and either the download link or course access instructions.
In all cases, the provider’s platform will email you a summary including features, price, date of contract, session date or downloadable material. For courses, access credentials will be emailed.
Any error in your information must be immediately reported to the email listed on the website.
Customer Service is available via the methods listed at www.montserratescoda.com or at info@montserratescoda.com. Alternate communication costs are the user's responsibility.
- Courses or ebooks: via Stripe. Payment redirects to the Stripe platform. Once successful, a confirmation email is sent with the order summary.
- Mentoring or consultancy: via bank transfer. You’ll receive payment instructions and must reference your order number and name. Payment must be made within 7 days or the order is canceled.
- Conferences: paid via bank transfer. Instructions and account number are sent at checkout. Must include order number and name. Payment is due within 7 days.
No delivery is made until payment is confirmed.
As these are digital services, MARIA MONTSERRAT ESCODA FORTUÑO will inform users about how to access or download the product.
Courses and ebooks will be accessible once the confirmation email is sent, within 48 hours maximum. Course access lasts 12 months.
Content delivery format is at the provider's discretion.
The User has the right to withdraw from the contract within 14 calendar days, in accordance with EU Directive 97/7/EC, without giving any reason and without incurring costs.
This period begins from acceptance of the GC.
Once the service has begun, the right to withdraw no longer applies unless otherwise agreed.
This right does not apply to legal entities.
No refunds will be given for unmet expectations.
Specifically:
- Courses and ebooks: no refunds unless defective and verified.
- Consultations: no refund if missed or cancelled, unless force majeure; rescheduling is allowed.
- Conferences: two payment options:
a) 25% deposit at booking; remaining 75% three weeks before event. Deposit is non-refundable; no refunds within 3 weeks.
b) Promotional bookings require full payment up front and are non-refundable.
The provider is not liable for service failures due to unforeseen circumstances beyond its control, including but not limited to: force majeure, riots, embargoes, civil/military acts, fires, floods, strikes, etc.
If any clause is found invalid or unenforceable, the remaining provisions shall remain valid.
10.1 Continuity and Consistency:
The provider commits to using all means to deliver quality service but may interrupt for maintenance or operational reasons. Clients will be informed in advance.
The provider is not responsible for user access issues due to internet, outdated systems, or viruses. The provider applies reasonable security measures but is not liable for illegal intrusions or data loss.
10.2 Service Quality:
The provider will deliver services diligently and refund or credit users only if a competent authority halts the training.
10.3 After-sales Services:
Users can request help or information by contacting info@montserratescoda.com.
10.4 Inactivity:
The provider may delete client data after 40 days of inactivity.
11.1 General:
The Client agrees they have reviewed and understood the service offer. The client must ensure the student identity is correct and that platform use follows the general guidance.
11.2 Course Participation:
Users must have internet access and proper equipment. The access credentials are private and cannot be shared. If a student leaves a company, the client must deactivate their access or contact the provider.
11.3 Client’s Responsibility:
The Client agrees to pay for any enrollments made under their designated student accounts.
The course is considered complete once all evaluations have been passed.
All content belongs to MARIA MONTSERRAT ESCODA FORTUÑO unless otherwise noted. No content may be copied, distributed, or used commercially without written consent.

The provider may suspend access without notice if terms are violated or service is discontinued.
These terms are governed by Spanish law. Disputes will be submitted to the courts of the user's residence (when considered a consumer).
